Pricing
picoBeat is a web site and service provided by picoBeat Pte. Ltd..
Registration and usage is free of charges unless stated otherwise. Sending of messages over the phone network (Short Message Service or SMS) is provided for a fee and charged on a per message basis, depending on the destination and the length of the message. All SMS submitted to picoBeat will be billed, no refund will be provided for dropped or lost messages.
Payment
picoBeat users wishing to use non-free features such as SMS service, must first purchase credits, each credit being sold for 1 €. Purchased credits are valid 2 years, after which they'll automaticaly expire with indemnification. No refund will be provided for unused credits. Payment is processed by a third-party payment gateway and no sensitive credit card information is ever received or stored by picoBeat Pte. Ltd..
Short Message Service (SMS)
Delivery of submitted Short Text Messages (SMS) is not guaranteed and in no event shall picoBeat Pte. Ltd. be held liable for any lost or dropped messages. It is strictly forbidden to:
- Send racist, libelous, illegal, harassing, threatening, harmful, obscene or otherwise objectionable content to anyone
- Send unsolicited messages (spam) to anyone
- Promote alcohol, sex, deception or gambling
- Deceive recipients about the originator of the message or spread false informations
picoBeat Pte. Ltd. will close without prior notice, indemnities or refund, any user's account that it deems in breach of these rules.
Data retention, deletion and protection
picoBeat will delete user's data on their request, provided that they demonstrate knowledge of their user name, password and associated email. Such deletion is permanent.
All accounts without any user activity (no access to the interface, no synchronization, no purchase or usage of credits) will be automaticaly deleted after 2 years of such inactivity.
Limitation of liability
This web site, as well as associated software, applets or gadgets such as "picoBeat Sync" and "picoBeat Notify", are provided "as is" and any express or implied warranties, including, but not limited to, the implied warranties of merchantability and fitness for a particular purpose are disclaimed. In no event shall picoBeat Pte. Ltd. be liable for any direct, indirect, incidental, special, exemplary, or consequential damages (including, but not limited to, procurement of substitute goods or services; loss of use, data, or profits; or business interruption) however caused and on any theory of liability, whether in contract, strict liability, or tort (including negligence or otherwise) arising in any way out of the use of these software, even if advised of the possibility of such damage.
Indemnification
You agree to indemnify, hold harmless, and defend picoBeat Pte. Ltd. and its affiliates, agents, subsidiaries from any claims and expenses including attorney fees and damages, actions or negligence arising in connection with your usage of picoBeat software and services (including, but not limited to, SMS and email messaging services).
